1) INDEMNIFICATIONS.
1.1
INDEMNIFICATIONS BY CUSTOMER. Customer agrees to indemnify, defend
and hold the Company, its owners and employees, harmless from and
against any and all losses, claims, demands, damages, liabilities,
costs and expenses, including but not limited to reasonable attorney
fees and costs of suit arising out of our "Customer use of
services provided to you by Skin Firmer Such indemnification shall
included, but not be limited to loss of data, claims for libel,
slander infringement of copyright, theft of misappropriation of
intellectual property, or unauthorized use of any trademark, trade
name, or service mark.
1.2 INDEMNIFICATION
BY Skin Firmer. Except as otherwise herein provided, Skin Firmer
agrees to indemnify, defend and hold Customer harmless from and against
any and all losses, claims, demands, damages, liabilities, costs of suit
(but excluding consequential damages) arising from our gross negligence
in the course of providing service under this agreement.
2) INTERRUPTIONS:
DISCONTINUANCES.
Skin Firmer is not, and will not, be responsible for interruptions
or discontinuances of service caused by factors beyond its control, including,
but not limited to equipment failure, delays, negligence, strikes, or
acts of God.
3) INFORMATION ACQUIRED
All information and contents thereof obtained using our services is the
sole responsibility of the customer. Skin Firmer, its owners or employees,
will not be held responsible for any damages you or another party suffer
as a result of our service. Transmission of any material in violation
of any U.S., state or local regulation is strictly prohibited.
4) CANCELING
AND RETURNS.
4.1) Canceling Policy
You are required to call us at 800-391-9111 and get a Cancellation
Authorization Number (CAN). We do not accept cancellation via email.
Canceling does not relieve you of liability for any outstanding
funds due to Skin Firmer. The same applies to international
orders. In case the package has been sent out prior to cancellation,
the client will pay return shipping.
We usually ship packages within 48 hours, if cancellation was reported
after the product has left our shipping facility, a shipping charge
is to be deducted from the clients account. ( normal shipping charge
is $5.95 for a package of 1 lb. or less)
4.2) Return
Policy
We offer great quality products at reasonable prices. Your satisfaction
is our utmost priority. If for any reason you are dissatisfied with
any of the products you have purchased at our site, you may return
the UNOPENED product for a full refund less shipping. Kindly call
us at 800-391-9111 to obtain a Return Authorization Number (RMA).
Returns will not qualify for credit without an RMA number.
Once you accept
the package, you have 15 days upon receipt to return it to us in
its original state; the seal should not be tampered with in any
way to be eligible for a full refund less shipping. (if shipping
is initially paid by us) After this grace period, we can no longer
accept the product. In instances that you used the product or if
any problems occur and you believe that the product(s) caused it,
you have the same 15-day grace period (upon receipt) and the contents
of the bottle should be 3/4 Full. The same holds true for creams
and lotions. We DO NOT credit back items that are almost empty.
We will not accept any returns in which the reason for the return
is something beyond our control such as mishandling and/or misuse
of product(s), tampering, etc.
A copy of your
invoice should be sent together with the item that you are returning.
Please indicate in the lower portion of your invoice the RMA number
for the return and a brief explanation of why you are returning
the product. 15% of the actual cost of the product is to be deducted
from the purchaser's account if the product returned is used or
opened.
Returns will be processed within 5 business days of receipt and
a credit will be issued in the original form of payment.
When returning
an item use a trackable and/or insured shipping method as we can
not be responsible for lost return shipments.
Please note that we do not accept returns on Jane Iredale products unless a customer
presents a physician's certification.

4.3) Shipping
Charges
If the shipping charge is initially paid by us (for orders above
$50.00) and you returned back the product it will be deducted from
the purchasers account (normal shipping charge is $5.95) to compensate
Skin Firmer for such expenses.
Product Exchanges, Etc.
4.4) For product
exchanges kindly give us a call at 800-391-9111 so we can assist
you and facilitate the exchange for you. A copy of your invoice
can be sent together with the item that you are exchanging plus
a note on which item you would like to exchange it for. We charge
a discounted shipping price of $3.95 for exchanges.
4.5) For your
other concerns (damaged items, incorrect item sent, etc.) please
give us a call at 800-391-9111 to inform us. We require a copy of
your invoice to be sent to us either by fax or mail before we act
on your concerns. You will be sent a self addressed stamped envelope/box
for you to re-send the damaged items or incorrect items sent. Your
account will be charged automatically in the event that you failed
to return the damaged or incorrect item that you received.
5) AMENDMENTS
These terms of service supersede all prior and contemporaneous agreements
or understandings, inducements or conditions, expressed or implied,
between Skin Firmer and the customer(s). Skin Firmer
reserves the right to change its rate and/or modify these Terms
of Service and Policies at any time including Terms and Conditions
and Privacy Statement, by posting the amended terms on our web site.
6) ACCEPTANCE.
Use of products from Skin Firmer or 1 day after you received
our package, constitutes acceptance of current Terms of Service
and online polices of Skin Firmer.
7) DOMESTIC
SHIPPING.*
We require a signature for all our deliveries. We do not accept
responsibility if the package is lost or stolen or if you opted
to leave instructions and waived the signature required policy of
the company.
We ship packages from Monday thru Friday. Our shipping cut off time
is 3PM ET/12PM PT. Any orders placed after that will be processed
on the following business day. Packages are delivered from Monday
thru Friday as well (business days only).
We do not have expedited shipping (Next Day or 2nd Day) using a
P O Box address. (A physical address is required if you opted to
have expedited shipping). This also applies to Hawaii, Alaska, Puerto
Rico and Virgin Island Orders.
All A.P.O and F.P.O delivery addresses are shipped via USPS Priority
Mail.
8) INTERNATIONAL
ORDERS
The client
must pay all customs duties for International Orders (orders outside
US). Please check with your customs office to find out your particular
custom policies in your Country. Orders outside U.S are shipped
via U. S. Express Mail.
In Cases of
refused delivery or unclaimed packages, the clients account will
be credited back only after we received the returned package less
shipping fee ( normally shipping fee is $30.00 if the order is below
$50.00)

9) COPYRIGHT
Unless otherwise indicated, all website materials, including, but
not limited to all designs, text, graphics, files and the selection
and arrangement thereof, are the sole and copyrighted property of
Skin Firmer. You may electronically copy and print hard copy portions
of the Site for the sole purpose of using materials it contains
for informational, non-commercial and personal use only. Any other
use of the materials in this website, including any commercial use,
reproduction for purpose other than described above, modification,
distribution, republication, display or performance without the
prior written permission of Skin Firmer is strictly prohibited.
10) COUPON EXPIRATION POLICY
We do not issue "ongoing" coupons. All coupons within
Skin Firmer expire within three months of their issuance.
